They are wrong. FE is the highest level, not on a plane. The reason * FE is the highest level of zero filling in T is completed on all lower energy states, and no two fermions can occupy the same state. There are more electrons all the way up to 1s. Most are not free, but frozen in place. But why do you think of the Fermi level can not be free? Electrons at the Fermi level of a driver is like a bird to reach it's free, but only in the solid.
